These Terms govern your use of Fast Aquatics ("the Platform"), a property of Fast Aquatics ("Fast Aquatics", "we", "us"). By creating an account, listing a product, placing an order, or browsing, you accept these Terms.
Fast Aquatics is a multi-vendor marketplace. We provide the platform; vendors list and fulfill products. Fast Aquatics is a marketplace facilitator under applicable state law and is responsible for collecting and remitting sales tax in jurisdictions where we have economic nexus.
Fast Aquatics does not own inventory, ship products, or carry product liability for vendor offerings (subject to applicable consumer protection law). The vendor is the merchant of record on each transaction.
You must be at least 18 years old to create an account or place an order. Wholesale accounts require valid business documentation (resale certificate, EIN, business license). Vendors must complete identity verification, packing certification, and execute the Vendor Agreement before listing.
You are responsible for maintaining your account credentials. Notify us immediately of any unauthorized access. We may suspend accounts engaged in fraud, repeated chargebacks, harassment, or violations of these Terms.
Live Arrival is governed by our Buyer Protection Policy. By placing an order you accept the reporting windows, photo evidence requirements, and dispute resolution process documented there.
The Living Guarantee is an optional, paid coverage product that you may add to eligible items at checkout. The Living Guarantee extends Buyer Protection past the standard arrival window for 1, 3, 6, or 12 months from delivery, depending on the tier you select. Premiums are non-refundable once the policy window opens, except as expressly required by applicable law.
The Living Guarantee covers the replacement value of the covered specimen only. Shipping fees on replacement orders or future credit redemptions are charged at the applicable vendor's standard rates and are not reimbursed under this Guarantee. Vendors may, at their sole discretion, opt to ship Living Guarantee replacement orders free; this is disclosed on the vendor's profile and on the listing page when applicable.
The Living Guarantee is offered only on listings from vendors who have opted into the Living Guarantee program ("Living Guarantee Members"). Listings from non-participating vendors remain covered by standard Buyer Protection but do not display the Living Guarantee upgrade at checkout.
Approved claims under the Living Guarantee are resolved through one of the following methods, at the customer's option:
The customer is presented with these options at the moment a claim is approved and selects the resolution method that suits them. Selection of one option is final upon confirmation. A customer who selects replacement and incurs standard shipping rates may not later seek reimbursement of those rates under the Living Guarantee, having declined the credit option that would have permitted free-shipping stacking at the participating vendor.
The 4-hour DOA window in our Buyer Protection Policy is not affected by the Living Guarantee and operates separately. Standard DOA claims continue to be resolved per the Buyer Protection Policy regardless of whether the Living Guarantee was purchased.
Orders to destinations forecast above 95F or below 32F during the transit window may be auto-held. You may waive the hold and ship anyway, in which case your DOA guarantee may be reduced or voided per the vendor's posted policy.
Buyers authorize charges to their selected payment method at checkout. Each vendor's portion is processed on that vendor's connected processor (Square, Stripe, PayPal, or Whop). Refunds are processed on the same processor.
Vendor subscriptions and wholesale buyer subscriptions bill on Fast Aquatics' own processor on the schedule disclosed at signup. Subscriptions auto-renew until canceled.
Vendors who exceed category-appropriate DOA thresholds, fail to respond to claims within SLA, or otherwise violate Fast Aquatics standards may be placed on probation, have listings restricted, or be removed from the platform per the three-strike system documented in the Vendor Agreement.
You agree to indemnify and hold harmless Fast Aquatics, its affiliates, officers, employees, and agents from any claims, damages, costs, and expenses arising from your breach of these Terms or your use of the Platform.
Vendors agree to additional indemnification specific to their products under the Vendor Agreement.
To the maximum extent permitted by law, Fast Aquatics' aggregate liability for any claim arising from these Terms or your use of the Platform is limited to the greater of (a) the amount you paid Fast Aquatics in the 12 months preceding the claim, or (b) USD $100. Fast Aquatics is not liable for indirect, consequential, or punitive damages.
Any dispute arising from these Terms or your use of the Platform shall be resolved by binding arbitration in Delaware under the rules of the American Arbitration Association. You waive the right to participate in class-action lawsuits against Fast Aquatics. You may opt out of arbitration within 30 days of account creation by emailing legal@wetyr.com.
We may update these Terms. Material changes will be emailed to your account email and posted here. Continued use after the change date constitutes acceptance.
